It's timed. Boss mods have a timer for it that it somewhat accurate at least and I know from our 10man tries that if someone dies to the plague it's not recast until the boss mod timer is up again....
The lastest buff (in 3.3.3) to DK threat made it easy for our DK to tank Keleseth in 25-heroic mode. We used a warlock before in normal mode and they had much more trouble.

Lockouts are the same as in Ulduar, and you don't get saved to a boss in normal/heroic, just saved to an instance if u killed a boss in either mode in it.
We tried that and couldn't get it to work reliably, after X amount of time/wipes the outside became heroic too, and then we run into the "cannot swap mode in 5min" thing. Blizz need to fix this...

if you get a debuff you need to swap around and boss happen to be immune to taunt,
then you do it old-school and over-aggro the current tank to facilitate a switch.
